Long An: Land use right certificates promoted to issue to resettlement people

The Department of Natural Resources and Environment (DNRE), in coordination with other departments, sectors and localities strengthened measures to promote the issuance of land use right certificates (LURCs) to resettled people; at the same time, it is recommended that people in the resettlement area actively proactively coordinate with branches and localities to facilitate the issuance of LURCs, avoiding affecting their legitimate rights and interests.

Attracting many investors to do project in the area creates conditions for local socio-economic development strongly in recent years. Also, the area of land recovered to make the project is relatively large. Long An has many policies and guidelines to support, especially the quick arrangement of land plots and issuance of LURCs for people whose land is collected so that they can soon settle down and earn their living.

In addition, the provincial leaders instructed departments, agencies and localities to coordinate in inspecting and urging project investors to strictly comply with the regulations, avoiding affecting the people’s legitimate rights and interests. 

Mr. Tran Huu Hoa (living in the residential area - Long Hau resettlement area, Long Hau commune, Can Giuoc district) said: “The family whose land is collected when doing Long Hau Industrial Park project. Firstly, we were hesitant, but the family handed over the land to do the project with the local propaganda and advocacy. We are located resettlement ground near the old land and was issued a LURC early. Besides, the investor was also very interested in, supported and created conditions so we felt secure and stabilized our life. My family now has a better life compared to that before, the income is quite good, thanks to being as a factory worker in the project and doing our business. In the past, we lacked capital, we used the issued LURC to mortgage the bank to borrow money to do business. Now we pay off the debt, redeem the LURC. The life of people in this resettlement area is relatively good, essential works are basically to serve the people’s needs. Hopefully, other places will be the same so that people whose land is collected like my family will soon stabilize their life”.

Reportedly, Long An Residential Area – Resettlement Area (Can Giuoc district) is the place to arrange for people whose land is collected when doing Long Hau Industrial Park project and planning residential areas to meet housing needs for people in the area invested by Long Hau Joint Stock Company. The project has a total area of 37 hectares, arranged 589 plots, has completed the infrastructure investment, layout and issuance of LURCs, people built 500 houses and lived stably.

Representative of Long Hau Joint Stock Company - Bui Le Thanh Hieu said: “When investing in the project, the company quickly coordinated with localities, departments and related agencies to complete the residential - resettlement area as prescribed”.

We understand the people’s difficulties and hard work, so the company invested in complete infrastructure before implementing the project, laid out the foundation and granted a full LURC, soon stabilizing the lives of people whose land was collected. Besides, the company coordinated with localities to explore, survey, capture the demand, create favorable conditions for resettled people to feel secure to live and do business.

Similarly, Phuoc Dong resettlement area (Phuoc Dong commune, Can Duoc district) is also quickly invested by the project owner to complete infrastructure, complete foundation layout and grant LURCs for people to settle down soon. This area has a total area of over 15 hectares, including 83 resettlement plots, people build nearly 40 houses and live stably.

Needing coordination

The arrangement of the ground and issuance of LURCs for people having land recovered in the province have seen many positive changes. Departments, branches and localities focus on coordinating to better implement this work. Some project investors are conscious and strictly abide by the regulations.

However, some projects still have certain shortcomings and difficulties. The arrangement and issuance of LURCs is still slow compared to the requirements, mainly due to the capacity of the investor.

For example, the project of resettlement area - Garden house residential area in Thanh Duc commune, Ben Luc district is invested by Phu An Infrastructure Development and Construction Investment Joint Stock Company. The whole area has a total area of over 82 hectares, with nearly 900 plots. However, the layout of the ground is still slow, although the authorities issued  LURCs to the investor but the investor mortgaged them at the bank, resulting in not being able to re-issue to people, directly affecting the rights and their legitimate interests, causing a sensation in the public opinion.

In addition, a number of projects whose land has been acquired by the resettled land will be transferred (mainly handwritten paper) many times through many different owners, so the issuance of LURCs is difficult to implement due to get stuck in the procedures as prescribed by law.

"The DNRE recommends that people whose land is acquired when doing projects and are resettled should coordinate with the branches and localities to carry out relevant procedures to achieve this. At the same time, people need to contact the local authorities, the project owner to complete and supplement the procedures immediately, or guide related procedures to arrange the resettlement ground or issue a certificate soon to receive land use rights according to regulations, avoiding affecting our legitimate rights and interests”.

Deputy Director of the DNRE - Nguyen Van Thong said that the work of arranging the plots and issuing LURCs for resettled people is more concerned and has more positive changes than before. However, some projects are still behind schedule. The main reason is due to the limited capacity of the investor. Some resettled people will sell hand paper and transfer it many times, leading to difficult owners identification; the person who was arranged the background and lost the certificate resulted in a dispute among family members (related to inheritance) affecting the implementation progress, etc.The Department repeatedly coordinated with other relevant departments and agencies, branches and localities to inspect and urge investors to strictly abide by regulations.

In order for this work to achieve the required plan, DNRE continues to coordinate with relevant departments, branches and localities to work with investors having resettlement projects to review, view progress, solve difficulties and problems arising. Also, the Department carried out the issuance of LURC separately, not granting the total project certificate as before; The issuance of LURC also clearly indicates below the resettlement arrangement to avoid the investor's mortgage status as before.

DNRE recommends that people whose land is collected when doing projects, which are arranged resettlement plots, need to coordinate with branches and localities to carry out related procedures to achieve this result. At the same time, people need to contact local authorities soon, the project owner completes and supplements the dossier procedures or is instructed related procedures to soon arrange the resettlement background or issue a LURC as prescribed, avoiding photos enjoy your legitimate rights and interests.

The whole province has 47 projects with a foundation for resettled people with a total area of nearly 1,200 hectares, concentrated in the districts of Can Giuoc, Ben Luc, Duc Hoa, Can Duoc, Tan Tru, Thu Thua and Tan An city. They were divided into 4 groups: Project group basically completed the assignment of land and granted certificates to resettled people (20 projects); the project group has completed the assignment of land plots, issuing certificates to investors and re-issuing the majority of papers to people (7 projects); The project group is assigning the plots and granting certificates to the people (14 projects); and project group is in the process of distraint, compensation and site clearance (6 projects). Up to now, the total number of resettlement plots is 18,480, the number of plots handed over to people is 17,299 (accounting for 93.6 percent of the total number of resettlement plots), issued 16,625 certificates to investors (accounting for 96 percent of the number of plots handed over to the people), re-issued paper to the people 15,297 (accounting for 92 percent of the number of plots handed over to the people), the number of plots of people to build houses of 5,376 plots./.
